Boston Marathon Bomber Tsarnaev Can View Victim’s Photos

The only surviving suspect, Boston Marathon bomber Tsarnaev, is now being allowed by a federal judge to view photos of the victims’ autopsies, a ruling that came Wednesday.

The judge, George O’Toole of the U.S. District Court in Boston, made the decision.  He rejected a claim by the government that it would upset the victim’s families if he was allowed to see their photos.  Usually lawyers are allowed to use the photos to prepare a defense, but the government specifically wanted to make sure that Dzhokhar Tsarnaev not see the photos himself.

The government argued that allowing Tsarnaev seeing the photos would cause unnecessary harm to the victim’s families.  Tsarnaev’s lawyers argued that they would know best what he should and should not see and O’Toole agreed with their argument.  He was not in court for this ruling.

So far, Tsarnaev has pleaded not guilty on 30 counts of criminal intent.  His next hearing is June 18th, but he goes on trial in November and could face the death penalty if he is convicted.  His brother and only other accomplice, Tamerlan Tsarnaev, died when the two were caught in gunfire from the police four days after the event.
