Attorney General Eric Holder is holding out the possibility of further criminal charges. The oil spill, which was the largest oil spill in U.S. history, killed eleven men in the explosion that sank the drilling rig and destroyed thousands of birds and other wildlife in the region. In a statement to the press, Holder commented on the situation, stating that,
“The Deepwater Horizon Task Force is continuing its investigation into the explosion and will hold accountable those who violated the law in connection with the largest environmental disaster in U.S. history.”

While the charges against Mix are unrelated to the numerous errors that led to the blowout and BP’s failed attempts to stop the spill, and do not allege any wrongdoing by the company when it comes to their policies, they help question what BP knew about the rate of the flow from the well and whether BP covered up that information. The flow rate of the oil spill is important as BP is subject to fines based on the amount of oil spilled, which are currently being negotiated. The Justice Department complaint states that right after the spill, Mix informed his supervisor that his own spill estimates were ranging from 64,000 to 138,000 barrels a day, which was way higher than the figures that BP reported publicly.
Kurt Mix was a drilling and completions project engineer for BP. The company declined to say why Mix resigned in January. While it is not clear who was exchanging text messages with Mix, it is clear that this latest development will help answer questions about the oil spill that remain unresolved.
